Most cases wouldn't reach a judge & jury. As you yourself point out defendants are "encouraged" to plead guilty to a lesser charge.
All too true and unfortunate that few who are charged with a crime ever have the opportunity to exercise their constitutionally protected (but not free) right to a fair trial... but are instead encouraged to bargain that away in the interests of expediency.
