I'm not claiming that BA is breaking a law. But it does seem they are testing a technicality/loophole that other carriers prefer to ignore.

Again - my information from ANAC suggests award travel is not specifically addressed in the legislation. Supporting evidence is that BA is YQ-free for revenue tickets.

It is indeed bizarre that BA risks antagonising the Brasilian authorities. Bizarre indeed that other carriers are content to act within what is believed to be the spirit of the law.

But again, the legality issue is your construct. It appears that the legislation is drafted in such a way that its applicability to non-revenue tickets is, at best, hazy. Until clarification is forced, the haziness remains, and BA is happy to play in that unlit arena. For both parties there are risks in forcing the issue.
