Seams to me like there is a valid question of which party was entitled to the $1.2B.
AA/UA paid out $1.2B. Silverman clearly had losses past what the insurance covered, thus could recover. The insurance company is also entitled to recover from this.
"Fair" would seam to be that the 2 parties would divy up the $1.2B based on losses (with Silverman's loss of course being reduced by what he was paid by the insurance company). But the law often is not about "fair".
