I'm not sure how you arrived at that inference without having analyzed the law applicable to the claims that were addressed at oral argument (not all of them were... several of the airline-specific issues will be decided on the papers). Very little, if anything, can be discerned from perceived "skepticism" by a judge or panel of judges at appellate-level oral argument.
