Anyways, before anything I was wondering if I actually in theory own all my points. I'm 50/50 business partners with someone but the credit card is under my name (my personal guarantee) he is a co-signer because his credit score wasn't high enough. Is my logic correct in thinking that since I'm taking the credit risk, that the points are mine to use?

What credit card is it? If it's a co-branded card for an airline or hotel, presumably the points/miles are going into one individual account (yours I would assume), at the end of each statement period. If it's a bank proprietary points card such as Citi ThankYou points I'd also assume the primary card holder - but check your CC account agreement and see if it addresses it.
Of course as
DirtyDan notes, technically the loyalty program "owns" the miles or points.
