Emirates can and will always give you a seat. As mentioned before, it will be a full-fare ticket though. I purchased 3 of them (24h-48h before departure) via phone in the past 2 months. No issue at all. They have to issue you one - just mention the seat guarantee. I even could purchase one for my wife which I nominated 5mins before as gold and flight was hardcore full.
