A. How is it illegal? Have you read the contract? I'm sure it allows for fees for changes after pickup.

B. What's wrong with Avis claiming they will prosecute for using things you're not permitted to? Per Merriam-Webster, fraud is the "intentional perversion of truth in order to induce another to part with something of value or to surrender a legal right." So using an AWD you're not entitled to falls into this category in my opinion.
