I suspect what happened is that at some point, if not already at ticketing time, VS decided not to operate on dec 24 and my reservation was moved to dec 25. I was never informed and delta still showed my flight departing on dec 24 until I raised the alarm and they rebooked me on BA.
Should Delta response be unsatisfactory, I'll definitely log a complaint with DOT and I may try the EC 261 route. VS would be guilty of never informing me of the schedule change, unless they never had that flight to begin with and all originates from an IT bug. My problem is that I don't know which is the case and if there never was a dec 24 VS flight Virgin Atlantic has no liability.
I don't think two GUC would be an unreasonable request, since 4 of them are deemed equivalent to a $200 delta coupon. In fact, it seems to me I'd be asking for too little.
My understanding is the EU 261 takes a stance that if the flight has been ticketed, the passenger has certain rights. However, usually schedule changes announced more than two weeks in advance don't lead to generous consumer protections.
