The other posters who advised you to meet with an immigration attorney are correct. Why would you jeopardize your entire family's USA residency status by shrugging off this issue?
I assume a 6 months passport validity for every country, but ALWAYS check as mentioned before. Sorry your 4-year-old and the rest of your family missed their vacation. I'm sure this won't happen to you again.
