I believe that lawsuit is over and found in BA's favour. You can redeem avios without 'exorbitant' fees, but then BA does not say that you will not be required to pay any cash component either.
Actually from the court docket it appears the case is in the middle of discovery. The judge denied BA's motion to dismiss:
