Thanks guys. I sent a "final" request through normal EXP channels to resolve this. I'll give them another week and then concurrently pursue both suggestions (CC dispute and further investigation into the EU regs).

In response to an earlier comment, yes, he could have stayed in LIS at his expense for a few days but needed to get back to the US (thus accepted the AA downgrade).
