They don't punish you or attempt to collect a fee from you: they just blacklist you from future rentals. They'll honor the unlimited mileage on that rental.

Again, I'm pretty sure rental agencies put these disclaimers in place to discourage traveling salesmen and people in similar jobs from living out of a Hertz car, week after week logging hundreds/thousands of miles on cars. They aren't trying to kick out the "regular" renter who takes a long family roadtrip once or twice a year.
