As I say, we probably could do with some more details! The operating carrier is responsible for the downgrade on the whole, and if that is a non EU carrier then that may get them off the hook, depends on the route. However if it was BA who arranged the downgrade then it falls to them. If BA offered multiple options, and the passenger chose this out of other alternatives, then no. Depends on the details.
