Those accounts are no longer open to new members. Ever since Capital One acquired ING, people in states where they don't operate are redirected to Capital One 360 (formerly ING Direct) which doesn't charge ATM fees but doesn't rebate surcharges.
I believe the Capital One branches do have a debit card that rebates surcharges, but you need to live in those states to get it.
