Silver doesn't owe your BIL anything - it's right on their Baggage Policy page:

The baggage allowance and fees of the first carrier in each direction will be applicable.
The only listed exemptions are SunPac and military. So if his first leg was on Silver, he was charged appropriately.

Silver isn't UX anymore, and they're not *A; they're a codeshare partner, like VS was (is?). There's no reason to expect United's airlines to apply to an otherwise unaffiliated airline.
