Hertz slapped on surcharge on rental through AutoEurope, what to do?
Seeking feedback on recent Hertz exxperience with an AutoEurope reservation, is my reasoning below correct? Thanks...
Just had a nasty surprise with AutoEurope (reservation in Spain, one way BCN-MAD).
Hertz billed an additional a EUR 40 Service Charge ("cargo de servicio"), a 45 EURO (one way drop charge) plus 17.85 EUR VAT charge to my credit card after the reservation.
Problem #1: AutoEurope's on screen price display showed the total price without listing any additional fees. AutoEurope emailed a voucher with a "Paid in Full" (!) followed by a long list of exclusions.
(IMHO, violates California Civil Code Section 1936 (n) (4):
If a rental company states a rental rate in print advertisement or in a telephonic, in-person, or computer-transmitted quotation, the rental company shall disclose clearly in that advertisement or quotation the terms of mileage conditions relating to the advertised or quoted rental rate, including, but not limited to, to the extent applicable, the amount of mileage and gas charges, the number of miles for which no charges will be imposed, and a description of geographic driving limitations within the United States and Canada.)
Problem #2: None of the exclusions on the AutoEurope voucher:
"* Insurance coverage for personal injuries...
* Local toll, highway fees or travel stickers...
* Rental excludes Collision Damage Waiver and Theft
Protection...
* Gasoline or Diesel...
* Location Surcharge of approximately EUR 49.00...
* Traffic Violation fee of approximately EUR 36.50 per fine.
or the "Additional Fees to be paid locally..."
* Additional Driver Fee
* GPS...
* Snow Chains...
* Ski Racks...
* Booster Seats...
* Child Seats..."
can be reasonably construed to be a Service Charge or a One Way drop fee.
I am disputing the charge with my CC company (Barclays Arrival Card).
