The fact that the gate sizer is smaller than the bin size is irrelevant to what is 'legal'. The sizer matches the dimensions that are filed with the FAA. Anything bigger in any dimension does not comply with FAA policy. If the dimensions matched the bin sizes, there would be different limits for each aircraft type.
