Sure, and that's perfectly fair as long as you didn't do it while the GA was processing the other EXPs upgrade at the gate just because yours wasn't gonna clear. While also lying to the GA so the GA would delay processing said EXP upgrade ahead of your upgrade.
The person made use of what was available to them
The agent chose to not process your upgrade whilst the passenger rebooked their ticket. The person rebooked their ticket into 1st class using available inventory and paid for it using a systemwide upgrade
You missed out on a complimentary upgrade due to an person paying using one of their 8 upgrades
The person simply made use of what was available to them. How is that any different to many situations put forward on these fora
