Why? It applies to any other industry or even government agency. It is always the employee and sometimes/often the employers responsibility too.
It just is the way it is. And often, no, the employee would not be liable, and most people wouldn't in their right mind sue the employee unless also suing the employer. It's bizarre to me that someone would think about making it you vs. the employee, and I know of no industry where that is the custom.
