Sadly US airports don't have sterile transfer zones for passengers like you who are "just passing through." At EWR you will mingle with C Concourse passengers who are domestic only, and you can just walk out if you want unchallenged. So you have to go through the rigamarole of "entering the country" when you arrive from PTY, even though you are leaving again almost immediately.
