"End up with" as in how did you get that itinerary (if it's illegal)? Usually it results from DL changing the times of flights. In that case, they're more willing to work with you to get something better for you.
It was booked for me by a family member so that I can attend a wedding; I think it was a naive non-FF, hence the non refundable code and weird connection. I certainly wouldn't have approved it myself given the choice and knowing it wasn't going to be a precleared flight. It is still being offered on KVS and Hipmunk, though, which leads to think either it's close enough to legal that it'll fly, or its not taking the lack of preclearance into account.
