IME there is some flexibility with this rule. On a normal climb-out once you get above 10,000 feet some FAs will say (if you have to use the lav) "you're not supposed to be up yet, but I won't stop you." If the captain has made a special announcement about turbulence then they will tell you to get back in your seat. I've also generally noticed more lenience in the FC cabin than in Y.
