U.S. law does not apply in Canada. That's a technicality? They're two entirely separate countries. Sounds like sour grapes to me. And EY is undoubtedly griping that pax are using a technicality (DOT regulations) to force it to honor their mistake fare and provide full ancillary services to F pax who may have paid less than a Y fare. EY would much rather have Canadian law apply.
I hear you. I fully expect QR and their lawyer to slam dunk on me! For them it is familiar, "been there done that". I'm just happy to have the opportunity to be heard. Even if I lose, I'm happy to fight. At least I'll have a SCC story to tell.
As far as DOT regulations go, they're ahead of everybody else, this is helping airlines, this will be the new norm. It will cause them to pay more attention to not making these mistakes in the first place. The easy way out is what QR is doing, just cancel. This is why we have lawsuits, money helps to modify behavior. I'm sure SWISS is probably now thinking maybe if we had just honored those fares like just about everybody else did we could have moved on by now.
