As an attorney, I would be shocked if Hertz let someone with a relatively recent (3-5 year old) DUI conviction rent a car. And certainly not during the time period that the person has a restricted license. Of course, Hertz doesn't pull a DMV rental record each time someone rents a car (or do they)? I would guess that the gentleman was snagged by a random spot check.
