I would say that it depends on who died.

If the death in the family is the spouse of a second cousin twice removed, you might not have as strong of a case to have a waiver granted as you would if the consanguinity of the relative is more direct — such as a parent or a child, for example.

I speak from personal experience, by the way.

As per the FlyerTalk mantra, you may want to call again until you reach a reservations agent who is sympathetic with your plight.
