Back in the day, Delta pulled this crap with their A fares - it was sold upfront as a First Class ticket, but buried in the fare basis was a -UP designator that no consumer should be expected to interpret.
From my point of view, this is misleading and possibly fraudulent - an instant upgrade fare should be clearly positioned as such to the consumer along with disclaimers appropriate to that fare.
