At least Am Ex will refund the prorate difference on an annual fee unlike Expert Flyer when Delta made the info unavailable.
The loophole is the statement in the T&C stated above which clearly reads "subject to change." AmEx was smart enough to know when they entered into this partnership with DL that DL may change the rules and AmEx has covered themselves with that one statement.
