I'm pretty sure NZ patented the concept as well as the actual product so no one can use it without licensing it.

It depends on what exactly CI licensed I suppose. SkyCouch only affects the seats on either side so the middle seats are not affected. So in theory, you could still have 3-3-3 and have SkyCouch. But I doubt that is the case. CI is probably using the same exact Y interior as NZ so 3-4-3. Honestly, it would be a financially irresponsible decision for any airline just getting 777-300ER now to install 9 abreast Y cabin.
