There is no "policy" because there is no FAA authority to permit the calls.
All we have is DL PR chatter which reflects today's competetive environment. That doesn't bind DL tomorrow, next week or next year.
Given that, if permitted, DL would be able to highly profitably monetize cell phone usage (industry consultants are talking in the dollars per minute range), the question will be whether DL gains more in revenue than it loses in dissatisfied pax.
Ultimately, people who think that their unlimited roaming plan will work in the air are headed for massive CC bills. Whether people will pay a couple of bucks per minute to chat with friends remains to be seen. And whether they will do business deals with their competitor in the next seat also remains to be seen.
