No, it actually sounds like he
didn't use the transport. He "knew" the flight would arrive significantly late so didn't take it. The flight, however, departed on time, but did arrive significantly late due to the diversion.
This seems like a bit of a gray area to me, in the absence of a published policy that should state whether a semi-voluntary refund is based on a late departure or late arrival. I can understand the logical arguments either way.
