You're in a bit of a jam because in reality, you didn't lose much. Yes you can go to court, but even small claims will run you a couple hundred or more, which is 30-40% of what you claim you lost.

Instead write a complaint to the CFPB and the OCC, which are the primary federal regulatory agencies for BofA. Also include your state AG and the BBB. I would even call them and tell them you are going to do this first though. Banks tend to take action when you mention these regulators and that you intend to contact them about a problem. Also mention that you believe this is a "deceptive and unfair trade practice" under state law and federal consumer regulations.

I use this tactic all the time and you usually end up getting a call from a VP who will fix your problem.
