Unlike selling miles, cents , etc there is little consequence to seller since there is nothing than can be realistically done to him to enforce this. He has not agreed to terms and conditions like the original purchaser of the pass, so there is no recourse against him.

To the buyer the obvious risk is they are counterfeit.
