Highest German Court: "Loyalty points are currency"
Guys,
I just read about a very interesting ruling from the highest German civil court (BGH).
It ruled against a large German retailer that unexpectedly stopped a loyalty promotion where clients could - in exchange for loyalty points - obtain a set of luxury knives.
In its explanation the BGH explains that the retailer had created "a form of currency" and should have given its clients "an alternative" when stopping the promotion. Consumers cannot expect that loyalty points suddenly lose their value.
Google "ReWe" and "Abbruch von Treuepunkte-Aktion" and you will find the relevant articles.
Go figure!! Why is this so different from Lufthansa devaluing its points (be it over night or over longer period of times)? Some lawyer opinions, please!
