If you have access to Club on the main deck, this would seem doubtful.
IIRC, wheelchair users can't use the 747 upper deck Club seats. But there is Club on the 747 main deck, and I've never heard it suggested that the upper deck restriction is in breach of any statute.
But if you're a wheelchair user and you've been able to get A380 upper deck seats already on other flights, then wouldn't that suggest that there isn't in fact a restriction?
