If the driver is penalized for,for filling the tank why not Hertz.

Although it doesn't address your comment about being credited for gas at a different rate than being charged for it . . .
someone on a different thread, same topic, suggested topping off the tank soon after you rent the car, then taking a photo of the receipt and the odometer. I thought this was a good suggestion. It verifies that the car was indeed less than full, although of course, would only allow reimbursement for out of pocket expenses, and possibly some goodwill certs (as opposed to the $9/gal), and no compensation for the hassle.
Maybe this was mentioned elsewhere, but i also just read an article about Avis and Hertz, and maybe some of the other rental companies are installing fuel meters, which can read fuel levels to the tenth of a gallon. This may help to prevent renting cars that are less than full.
It may also mean that you should keep all gas receipts, and check your credit card, even after returning the rental car.
