Oh yes it has. Para 15: "[After discussing the evidence], it seems to me obvious that the Defendant [i.e. Deutsche Lufthansa Aktiengesellschaft T/A Lufthansa German Airlines] would not have gone through with this litigation if it had not thought that a mistake had been made. Despite the Defendant’s short and deficient evidence, therefore, I am satisfied that there was an error."

Still they lost. And had to pay Claimant's costs to the tune of GBP 11'730, despite the Judge giving his solicitors a clip round the ear for wasting time on client correspondence
