As you already know, EU261 states:-
‘Community carrier’ means an air carrier with a valid operating
licence granted by a Member State in accordance with
the provisions of Council Regulation (EEC) No 2407/92 of
23 July 1992 on licensing of air carriers (1)
I think that you will find that Thai Airways' operating license was granted in Thailand, and that their "head" office is in fact in Bangkok. The fact that they also have offices in the EU does not make them a "community carrier". If it did then vitually all airlines of any significant would be community carriers. Thai may owe you something but I think you are wasting your time attempting to press the EU261 route.
