Speeding and DUI can both lead to an accident, repairs, loss of potential rental revenue, etc. DUI is more serious, of course. Some states treat it as a felony while others treat it as a traffic violation, but still with very stiff penalties like jail time.
If a driver, with a several year old DUI conviction who now has a current, valid license causes an accident while in a rental car and the police do not determine there to be drinking involved, I don't know how an attorney could bring that into evidence as a liability issue or negligence on the rental car company. But lawyers will use any and all means to make a case, so...nothing is off the table I guess.
Nonetheless, it just made me wonder how often they pull driver records from long standing Gold members versus a new customer without any membership with them.
