It's all a matter of local law. There is zero point in renting a car to someone not in possession of a physical DL in Kanasas if Kansas law does not permit that person to drive on public ways without a physical DL (unless OP intended to drive around the parking lot at National).

That bit of information from OP would be helpful and would also explain the differences between how these issues are handled in different placs.
