The way it works in the UK and Italy is that the owner of the vehicle is sent a form requesting the name of the driver. They can of course lie, but that happened to result in a UK politician quite spectacurarly going to jail recently. In Italy it's a bit different. If the owner (or I guess renter), ignores the notice to identify the driver they just pay a much larger fine but don't get points.
