Not sure I see the problem.
How about EU261, Article 8b " re-routing, under comparable transport conditions, to their final destination at the earliest opportunity"

Others may disagree, but I do not find the next day to be the earliest opportunity, especially as article 8c specifies a later date, at the customers convenience (and he has stated it was not convenient.)
