The FA moved her and kid to some empty seats in business. When I took my midnight stroll her other kids were happily playing games on the console in business class. Obviously she got free seats in business class. Do adults ever get upgraded when we walk up to business during take off?
Please name the carrier. Different airlines have different rules, but sitting in a higher class than one's ticket is theft of services and would generally not be permitted on any carrier--with some exceptions if they were the pilot's kids, etc.

On DL, if an adult isn't sitting in the same cabin as kids under 15, the UM fee would be required. Moreover, on DL, FAs are absolutely not allowed to upgrade passengers during the flight. Since even upgradeable fares are very expensive, letting the kids ride in BE would not be permitted.

You should complain to the airline, although you should have complained to the purser when the kids first came up into the cabin.
