If I rent a car and the tank isn't full

The last 3 rentals I've had we're marked as full but the tank was 1/2 or 3/4 (LEX). When I complained they would only credit the fuel paid not the $9.00 per gallon.

At SLC the Prius I was given as an 'upgrade' (what a POS) took 4 gallons for a 40 mile rental. Worse mileage than a Lamborghini Aventator (700 HP and 0-60 under 3 seconds). They agreed and credited the cost of 3 gallons but not at the $9.00 rate.

If the driver is penalized for,for filling the tank why not Hertz.

I did complain and got $$ off certificates but I shouldn't have to go through this.
