Just because she was fine doesn't mean it wasn't assault. Just means it wasn't worth calling a police officer over and asking for charges to be filed.

If it had just been a drunken idiot being loud it would be one thing. But once it strayed over into somebody else being physically affected by it, it moved beyond somebody's "right" to be a drunken idiot.


Note: I don't remember seeing a right to be a drunken idiot in our Constitution, hence the quotes above.
