Only ten states prevent surcharges in the US, and only on transactions in those states. In the other 40 states, as of January 27, there can be credit card surcharges up to the Merchant discount rate or 4%, whichever is lower.
Again though it's based on where the transaction is made, not where the card was issued.
Huh, I didn't know that law had changed to allow businesses to put the CC processing fee on the customer. And I guess now I don't know which side I'm on, either.
