The current T&Cs state they have to give us notice, unless it is not possible. I don't think we have had the truth on the removal of the benefit. I am awaiting another call from Executive Relations today and will tell them I want the truth or I go to the FOS.
It's not commercially sensitive to state exactly when banAMEX knew they could not extend the HH contract.
It doesn't "allow" it. It just helps them to minimise complaints because the first stage is to fob people off with this. They can say what they want in their Ts and Cs but anything that doesn't comply with Banking guidelines is unenforceable. I am 99% confident that the only time they would be allowed to use the term was if they themselves didn't know ie outside of their control .... but even then I'm pretty sure that a complaint wouldn't support their side.
They are supposed to be able to run a bank with "no surprises" and not purposefully withhold important benefit or terms information from customers.
