If you would do so on an OS or LH flight on either a ticket issued in Austria or a flight departing in Austria (the latter cannot work with your example) you would be covered by the recent verdict of the Austrian Supreme Court.

The LH decision was just a "follow up" decision holding that the LH rules are as void as the OS rules. Given that it can be expected that other airlines will face the same fate and this will hopefully result in reasonable o/w fares (as eg offered by AB or even by LH on routes where they face competition). As consumer protection law is EU competence I would expect similar evelopments in other jurisdictions too.
