They were fairly clear in the press they don't care if the site is up or not
In the lawsuits, United said it is not trying to prevent Jeremy Cooperstock from operating a website where people can express their views about United, but is instead trying to protect its intellectual property, such as its logo, and trying to alleviate confusion by United customers who might think they are filing a complaint with the airline on Untied.com
In April they redesigned the site to look exactly like the United site. Had they not done that, probably United never would have acted.
I find it odd that the owner of untied was so upset about being told to stop illegally misusing UA's logo. No company allows someone to take their logo and use it as they wish, much less for a purpose like this. The owner of the site got away with this for much longer than I would have expected.
