Later I did immigrate. Now there were other issues when we travelled to visit my family back in Sweden depending in what state we landed. Some states have just one line for US citizents and legal residents. Other have lines for US citizents and then legal residents/tourists.
Now they did not like again that I was swedish/legal resident and in another line. That cause it caused problems with my US husband and customs. Agains we were a family and have to travel as one.
So it all depends on the immigration and custom agent you get at the time.
CBP is inconsistent in its handling of people involved in your kind of situation, so it indeed does seem to depend on the CBP employee you get at the time.
