Supposition #2: What if the F-16s were from an Air National Guard unit or if the Hawk battery was an Army National Guard unit? If they were on the clock as NG, would the law of armed conflict apply if they happened to be employees of a particular state governor?
In the case where the unit in question is providing the air defense mission (be it Air or Army National Guard), wouldn't they be executing a federal mission and therefore operating under the defense Titles? (I'm forgetting the numbers that apply to federal and state functions).
